Fees
Fees paid for the posting of advertisements on buyMYheels.com are non-refundable regardless of whether the item is sold. The fees posted on the site are the current fees applicable to available services at that time and any changes to the fee policy will be notified to you via publication on the site. You should check the fee total before confirming the submission of your posting. If your payment fails for any reason, we reserve the right to suspend or remove the item until payment is made and confirmed.


Content of Advertisements
Each user is responsible for the content of their advertisement. The user must make sure that the advertisement it posts is accurate and contains true and non-misleading information.

Your advertisement must not contain content that infringes the rights of third parties. In particular you must take care to ensure that your advertisement does not contain any content that infringes the intellectual property rights of others such as copyright and trademark. In addition to breaching the terms and conditions of this site, offering counterfeit goods for sale almost certainly infringes the intellectual property rights of others and will be dealt with in accordance with our Infringement Policy.


Authenticity
Replicas, counterfeit items, and unauthorised copies policy. Items that bear a company's official brand name or logo can be listed as long as the products were made or officially endorsed by that company.

For a safer buying and selling experience on buyMyheels, we don't allow listings for counterfeit items, fakes, replicas, or unauthorised copies. Unauthorised copies include shoes that may be duplicated or pirated—which are all illegal. These kinds of things may infringe on someone's copyright or trademark.

Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account. If your item is removed, you will receive an email explaining why. If you feel your item was removed incorrectly please contact us.

Remember, this is your community and with this in mind, if you do see shoes that you believe are listed incorrectly, please let us know.


Infringement Policy
While advertisements are posted by private individuals and buyMYheels.com cannot be held responsible in any way for any breach by a user of the intellectual property rights of third parties, if the owner of copyright, trademark rights or other property right sees an advertisement which may infringe their rights, they can report any such advertisement to buyMYheels.com requesting that the offending advertisement be removed. In order to deal with such requests, buyMYheels.com requires the owner or otherwise properly entitled party to contact us and Request for Removal. Please note a Request for Removal can only be acted upon if submitted by or on behalf of the lawful owners of the relevant intellectual property rights.


Liability
You agree not to hold us responsible for things other users post or do. We do not review users' advertisements and are not involved in the actual transactions which are carried out between users. All the content of individual advertisements on buyMYheels.com comes from other users and accordingly we do not guarantee the accuracy of advertisements or give any assurance on the quality, safety, or legality of what is being advertised.

In no event do we accept liability of any kind for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including, without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.

We are unable to guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of buyMYheels.com, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you. Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Pounds Sterling.

Nothing in these terms limits our liability for (i) fraudulent misrepresentation or (ii) death or personal injury resulting from our negligence or the negligence of our agents or employees.


General
These terms and the other policies posted on buyMYheels.com constitute the entire agreement between buyMYheels.com and you, superseding any prior agreements.

This Agreement shall be governed and construed in all respects by the laws of England and Wales. You agree that any claim or dispute you may have against buyMYheels.com must be resolved by the courts of England and Wales. You and buyMYheels.com both agree to submit to the exclusive jurisdiction of the English Courts; for claims falling within the jurisdiction of a County Court, you and buyMYheels.com both agree to submit to the jurisdiction of the Central London County Court.

If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.

Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to BuyMYheels.com at 4 Evans Wharf, Apsley, HP3 9WU, United Kingdom. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing.

We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the site, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.

From time to time we may monitor emails for the safety of users.


Disputes

If you have any dispute with regard to the goods received, you should try and resolve this with the seller. If you wish to report such dispute to us, we will investigate the matter and make every effort to maintain the legitimate nature of the business.  It is important to note that we use PayPal Buyer Protection and all disputes should ultimately be made through them as they will investigate the matter and go from there.  Please go to the PayPal Buyer Protection for further information. 

If the resolution carried out by PayPay is in the buyers favour, the seller will be removed permanently from the site
